Mortgage Foreclosure Special Representative

Pursuant to Supreme Court Rule 113, mortgage foreclosure cases involving deceased mortgagors where no probate estate has been opened require the appointment of a special representative in order to acquire subject matter jurisdiction. Our firm’s attorneys have administered numerous cases involving special representatives and understand the timeliness of this process. Our firm will:

  • Work to reduce and improve foreclosure timelines
  • Search for heirs of the mortgagor
  • Perform obituary and skip-trace searches
  • Attempt contact with heirs
  • Personally visit the subject property
  • Determine whether heirs may have a defense to foreclosure
  • Prepare and file a Special Representative Report within 21 days
  • Remain in constant contact with your firm regarding this process

Our special representative services comply with the requirements set forth in Rule 113 as well as in ABN AMRO Mortgage Group, Inc. v. McGahon, 931 N.E.2d 1190 (2010).
