Pursuant to Supreme Court Rule 113, mortgage foreclosure cases involving deceased mortgagors where no probate estate has been opened require the appointment of a special representative in order to acquire subject matter jurisdiction. - Search for heirs of the mortgagor
- Perform obituary and skip-trace searches
- Attempt contact with heirs
- Personally visit the subject property
- Determine whether heirs may have a defense to foreclosure
- Prepare and file a Special Representative Report within 21 days
- Remain in constant contact with your firm regarding this process
